The department initially implemented specialized medical guidance in February 2017 to help DLA staff evaluate claims involving congenital heart disease. However, following extensive evaluation, this guidance was substantially revised and replaced with updated criteria in October 2020.
How the Review Process Works
The DLA unit is now systematically re-examining all decisions made during that three-and-a-half-year period, applying the more current 2020 guidance rather than the original 2017 standards. This retrospective application of newer criteria means that some families may be entitled to substantial arrears for previously underpaid benefits.
Contact has clarified that the review specifically targets cases where:
- The child had congenital heart disease listed as a medical condition
- The DLA decision about that child's claim was made between February 1, 2017 and October 13, 2020

Cases Excluded from the Review
The DWP has established clear parameters for which cases will not be re-examined. The review will not include:
- Decisions made before February 2017
- Decisions made after October 13, 2020
- Cases where children received the maximum DLA rate throughout the entire period
- Decisions that were ultimately determined by appeal tribunals
For maximum rate cases, this specifically refers to children who received the high rate of both care and mobility components, or the highest care rate for those under three years old throughout the review period.
