Consumer champion Martin Lewis has taken decisive action against two prominent high street brands, reporting both Evans and Carluccio's to Trading Standards over misleading returns policies on their websites.
Misleading Returns Policies Exposed
The MoneySavingExpert.com founder identified significant discrepancies between the companies' stated returns periods and actual consumer rights under UK law. Fashion retailer Evans, which forms part of the Arcadia Group, currently states on its website that its "standard returns policy is 21 days for online orders."
However, Martin Lewis's team clarified that consumers actually have substantially more protection. "You have 14 days to change your mind, then a further 14 days to return the item, so a maximum of 28 days," the finance expert confirmed.
Restaurant Chain Also Under Fire
Italian restaurant chain Carluccio's, which operates an online gift shop, faces similar criticism for stating: "You can return goods to Carluccio's Online within 14 days of delivery."
Again, this falls short of legal requirements. MSE emphasised that customers actually have "14 days from delivery to change your mind, then a further 14 days to return the item" - effectively providing a 28-day window.
Wider Investigation Reveals Systemic Issues
The confrontation follows extensive research conducted by Martin's team, which examined over 400 of Britain's most popular retail brands. The investigation revealed that 30 companies were providing incorrect information that suggested customers had fewer rights than the law permits.
While the vast majority of identified businesses promptly corrected their policies following Martin's initial intervention in July, both Evans and Carluccio's have failed to make the necessary changes to their websites.
During his ITV programme, The Martin Lewis Money Show Live, the consumer champion issued a direct warning: "Evans and Carluccio's, you are wrong. Your websites are misleading, change them please. I have reported you to Trading Standards."
The action serves as a stark reminder to all retailers about the importance of accurately representing consumer rights and comes as Martin continues his campaign to ensure British shoppers receive the protection they're legally entitled to.
