Darawan Omari, 29, of Ludstone Road, Birmingham, has been disqualified from driving for 48 months after admitting failure to provide a specimen for analysis. The ban was imposed at Dudley Magistrates' Court on August 20, following a collision in West Bromwich in the early hours of July 12.
Omari was driving at around 1.10am when he swerved to avoid a couple of electric bikes or scooters travelling on the wrong side of the road and collided with a wall. He remained at the scene and was arrested on suspicion of driving under the influence after a roadside breath test.
Evidential sample issues
While in custody, police believed Omari was deliberately avoiding providing samples for evidential testing. Officers said he was blowing short and not continuously blowing enough to provide a reading.
Omari admitted the offence when he appeared before magistrates. The court heard he was employed by a car valeting business, where he previously washed vehicles. Following a severe back injury, he was now tasked with paperwork, a part-time role that allowed him to work the hours he chooses.
Defence explains circumstances
Abid Hussain, defending, said Omari was leaving the premises after finishing work late at night when the collision occurred. The court was told Omari had moved a car blocking the driveway to park on a side road, and due to a couple of electric bikes or scooters on the wrong side of the road, he swerved and collided with the wall.
Mr Hussain said Omari had stayed at the scene and later explained to police what he was doing.
Financial penalties and disqualification
Magistrates fined Omari £307 and ordered him to pay a surcharge of £123 and £85 court costs, bringing the total court bill to £515. In addition, he was disqualified from driving for 48 months.
Omari, who is awaiting British citizenship, will face the full consequences of the ban and financial penalties as set out by the court.
