Illegal Immigrant Avoids Jail for Racist Pork Attack on West Bromwich Gurdwara
An illegal immigrant who cruelly dumped raw pork outside a West Bromwich gurdwara has avoided immediate jail time for his racist attack. Tomasz Bruch, 42, was caught on camera dropping the meat at the gates of Guru Nanak Gurdwara on Victoria Street before casually walking away from the scene of his crime.
Court Hears Details of Hate Crime
The court heard how Bruch, who has no right to be in the UK, left members of the Sikh community upset and in fear over his hate crime committed on December 22 last year. Meat is strictly forbidden on the grounds of and within gurdwaras, making this act particularly offensive.
Prosecutor Kathleen Price told Wolverhampton Magistrates' Court that this was a deliberate racist crime. Dalwinder Kang, a member of the congregation, said in a statement read to the court that the dumping of meat outside the gurdwara was extremely offensive and disrespectful to their faith and community.
Community Impact and Legal Proceedings
Mr Kang continued, stating that the matter caused significant alarm, anger, hurt and distress to himself and the wider community. He also wondered if Bruch had mistaken them for Muslims and was attempting to target the Islamic faith rather than Sikhism. Nevertheless, he believed Bruch targeted their gurdwara, community and religion based on prejudice.
The court heard how Tomasz Bruch, who was assisted by a Polish interpreter, has been on remand in custody since January 16. His defence lawyer, Ms Yasmin, said the offence was out of character for Bruch and that he had shown a level of ignorance. She added that he expressed being very sorry for his actions.
Sentencing and Consequences
Sentencing, District Judge Michael Wheeler said Bruch clearly targeted a religious group and caused them distress or alarm. He stated that religious aggravation was the predominant motivation for the offence, with no other explanation possible. Severe distress was caused to members of the Sikh community who witnessed the incident, and serious fear and distress was caused to the wider Sikh community.
District Judge Wheeler said he could suspend Bruch's sentence due to time spent on remand. Bruch, of Harvills Hawthorn, West Bromwich, admitted racially or religiously aggravated intentional harassment or alarm or distress. He was handed an eight-month sentence, suspended for two years, with a 15-day rehabilitation activity requirement and 150 hours unpaid work.
Additional Penalties and Final Warning
The convict, who had no previous convictions, was handed a five-year restraining order banning him from going within 500 meters of the gurdwara. Bruch must also pay £1,000 compensation to the gurdwara, a £187 victim surcharge and £85 costs.
District Judge Wheeler added that he made it perfectly clear in sentencing that had Bruch not spent the last five weeks in prison, the sentence would have been immediate custody rather than a suspended sentence. He stated that he does not expect to see Bruch in court for breaching the order or offending again. The sentence means that Bruch will now be released from custody at HMP Hewell. No mention was made in court of whether he will be deported.
