HMRC has confirmed its clawback mechanism for the Department for Work and Pensions (DWP) bonus payouts, which are due to land in the winter. HMRC is set to change state pensioner tax codes to recoup £300 Winter Fuel Payments. Under new rules introduced under the Labour Party government, recipients of the £100 to £300 allowance who have an income of more than £35,000 will have to pay it back.
This is an automatic process for most, as the money is deducted by the Government through higher taxes. It means HMRC will change tax codes. Pensioners do not need to make any payments directly.
HMRC Warns of Scams
"Criminals are great pretenders and often use fake letters, emails, calls and texts to impersonate HMRC and trick people into giving them money," said Myrtle Lloyd, HMRC's chief customer officer. "I’d encourage anyone who’s unsure to use our online tool at Gov.uk to check whether and how their payment will be recovered – there’s no need to call us."
Background on Winter Fuel Payment Changes
Chancellor Rachel Reeves humiliatingly restored winter fuel payments last year for most pensioners after introducing a tough means test on the allowance in 2024. Responding to the u-turn, one retiree said: "I’m not entitled to a winter fuel payment and I never received one, before this year. The incompetent U.K. administration gave me a winter fuel payment which it will claim back on my next tax return. What a bumbling inefficient bureaucracy. And incredibly I don’t qualify to opt out. So I’ll get another one this year, which they will take back next year. You couldn’t make it up."
A second asked: "If you meet the criteria for WFA over a certain week in September, and haven't opted out of receiving it, then it's paid automatically. Then, at the end of the financial year, HMRC check your taxable income for that year and, if it was £35K or over, they adjust your tax code to recover the WFA. Why didn't you 'qualify' to opt out of receiving it? Did you leave it too late? If you really do live in Singapore (which is one of the Countries that don't qualify for UK WFA) do DWP have your correct address on their records?"
