Elanki Fashions, a clothing store on Soho Road in Birmingham, has been fined £2,000 for improperly disposing of rubbish by leaving black bin bags near bins on one of the city's busiest streets.
Court Hearing Details
Birmingham Magistrates heard that the Asian clothing business left bags containing general waste by bins near the shop instead of disposing of them correctly. The offense came to light during a trade waste inspection by city council officers on April 16, 2025.
The company provided conflicting information about its waste disposal methods, with director Joy Shanker Das claiming she took waste to her home in Solihull. A demand for information notice was served under the Environmental Protection Act 1990, but the company failed to respond despite a reminder issued on May 9 last year.
Prosecution Statement
Megan Stanley, prosecuting for Birmingham City Council, stated: "It was a large amount of rubbish left outside the business, causing problems to the community." She added: "We do have a bins crisis going on in Birmingham. There is no excuse for businesses to add to the bins crisis."
Penalties and Consequences
Elanki Fashions was ordered to pay a surcharge of £800 and costs of £2,077 alongside the fine. No representatives from the company appeared at the June 18 hearing, and it was found guilty in its absence. A warrant was issued for Shanker Das, who also failed to attend court.
