A fresh retrospective planning application has been submitted for a home in Paddock that has been at the centre of a four-year planning row. The property, located at 8 Brookhouse Road, is currently subject to an active enforcement case after initial plans were approved but later found to be based on inaccurate drawings.
Background of the Dispute
In 2022, Walsall Council approved plans for a replacement five-bedroom home on Brookhouse Road, subject to a condition that a 45-degree line of sight from neighbouring windows would not be breached. However, the submitted drawings were later discovered to be inaccurate, which the council described as an 'oversight'. As a result, a Breach of Condition Notice was served on the owner but was subsequently withdrawn due to the inaccuracies.
First Retrospective Application Refused
Last year, applicant Idnan Choudhry lodged his first retrospective planning application to regularise the three-storey home. That application received five objections and was refused on grounds that it caused 'unacceptable levels of harm' to number 6 Brookhouse Road, was 'visibly incongruous', and that the front boundary impacted visibility for pedestrians and drivers.
Second Retrospective Bid
Now, Mr Choudhry has submitted a further retrospective application in an effort to regularise the property. The outcome of this new bid is pending, as the council continues its enforcement case.
