M6 drivers fined for going under 70mph

Thousands of drivers on the M6 in the West Midlands are being caught out by a little-understood rule, receiving fines even when travelling below the 70mph national speed limit.

The locations with the most fines

New data reveals that specific sections of the motorway are hotspots for penalties. The two areas where drivers are most frequently caught by variable speed cameras are between junctions 7 and 8 near Great Barr and on the stretch between the M54 slip road near Wolverhampton and junction 10 for Walsall.

In 2024 alone, these two locations accounted for nearly 20,000 motorists being captured by cameras.

How variable speed limits work

Unlike the static 70mph limit, variable speed limits are used on smart motorways to manage traffic flow. These limits, which can be set to 40, 50, or 60mph, are displayed on overhead gantries and are legally enforceable during certain times, such as heavy congestion or poor weather.

This means a driver could theoretically be fined for travelling at 45mph if the displayed limit is 40mph. The RAC explains that these cameras function similarly to average speed cameras but are not necessarily active 24/7.

Why compliance is mandatory

A common misconception among motorists is that these lower limits are merely advisory. However, this is not the case. Compliance with the illuminated signs is mandatory, and failure to adhere can result in a fine.

With over 20,000 punishments issued in this way last year, it is clear that many drivers are unaware of the rules or the potential consequences of ignoring them.
