The Financial Conduct Authority (FCA) has officially banned misleading online adverts featuring Money Saving Expert Martin Lewis that have been circulating for months, if not years. These unauthorised promotions have been used to make false claims about average motor finance compensation amounts, despite having no connection to the real Martin Lewis.

Claims Management Company Forced to Remove Content

Conclusive Financial Ltd, which also trades as PCP Refunds, has been required by the FCA to remove its advertising and update or take down its website until it complies with regulatory rules. The company's adverts claimed consumers would receive £1,846 on average for motor finance compensation, but failed to explain how these figures were calculated or where they originated.

Martin Lewis expressed his satisfaction with the regulatory action, posting on social media platform X that he was "delighted" by the news of the ban. The financial expert has been warning against these misleading promotions for an extended period.

Regulatory Violations and Consumer Protection

The FCA's investigation revealed multiple violations by the claims management company. Conclusive promoted a 'No Win, No Fee' service without properly explaining the fees involved, including any exit charges consumers might face. More importantly, the company failed to inform consumers that they could make claims directly to their lender or through the Financial Ombudsman Service without needing to use a claims management company at all.

Alison Walters, director of consumer finance at the FCA, issued a stern warning: "Consumers should be wary of adverts that overpromise or give the impression they are endorsed by the FCA or well-known individuals. We will take swift action where rules are being broken."

Broader Regulatory Crackdown on Misleading Financial Advertising

The action against Conclusive Financial Ltd forms part of a wider regulatory effort to improve standards in financial advertising. A joint taskforce has recently been established involving the FCA, Solicitors Regulation Authority, Advertising Standards Authority and Information Commissioner's Office to coordinate enforcement activities.

Since January 2024, claims management companies have removed or amended 899 misleading adverts following FCA intervention. This represents a significant regulatory push to protect consumers from deceptive financial promotions.

Consumer Guidance and Complaint Procedures

The FCA has provided clear guidance for consumers who may have been affected by these misleading adverts. Those who have engaged with Conclusive and believe they were misled should complain directly to the company first. If unsatisfied with the outcome, they can then refer their complaint to the Financial Ombudsman Service.

For consumers who signed up with a law firm as a result of seeing these adverts, the FCA recommends complaining directly to the law firm initially, then escalating to the Legal Ombudsman if resolution isn't achieved. The regulator emphasizes that their compensation scheme remains free to use, and consumers don't need to employ claims management companies or law firms to access it.
