A 46-year-old man from Birmingham has been sentenced to 10 years in prison after assaulting a 10-year-old girl in a park. The attack took place in July 2023, leaving the victim and her family deeply traumatised.
The Incident
The assault occurred in a park in the Kingstanding area of Birmingham on the afternoon of July 15, 2023. The man, identified as David Smith, approached the girl and subjected her to a serious sexual assault. A passerby heard the girl's screams and intervened, causing Smith to flee the scene. Police were called and launched an immediate investigation.
Arrest and Trial
Smith was arrested later that same day following a public appeal for information. He was charged with sexual assault of a child under 13 and appeared at Birmingham Crown Court. On March 12, 2024, he pleaded guilty to the offence. The court heard that Smith had a previous conviction for a similar offence in 2015.
Sentencing
On April 5, 2024, Smith was sentenced to 10 years in prison. He will also be placed on the sex offenders register for life. In sentencing, the judge described the attack as "a devastating breach of trust" and praised the bravery of the victim and her family.
Victim Impact
In a statement read to the court, the victim's mother said: "Our daughter has been robbed of her childhood. She no longer feels safe playing outside. The trauma will stay with us forever." The family has received support from specialist police officers and charities.
