Father Escapes Jail After Threatening Mother Over Child Visit Request
A 28-year-old man who threatened to 'batter' the mother of his child after she refused his request to see their daughter before he went to prison has avoided a custodial sentence. Callum Lacey unleashed a vile tirade during the confrontation, which left the woman terrified for her safety.
Incident Details and Court Proceedings
The incident occurred on August 26, 2024, when Lacey approached the woman and informed her he was likely going to prison. He asked if he could see his daughter beforehand, but when she refused and threatened to call the police, he became enraged.
Prosecutor Emma Thompson told North Staffordshire Justice Centre that Lacey responded by saying he would give her "something to f****** call them about" before threatening to 'batter' her. During his outburst, Lacey also referred to his own daughter using extremely abusive and derogatory language, calling her an 'ugly little c***'.
Impact on the Victim
A victim impact statement read to the court revealed the profound effect of the incident. "The incident has made me frightened," the statement said. "I know what he is capable of and I am scared he could follow through on the threats he is making." The woman described living in fear following the threats and abusive language directed at both her and her child.
Defense Arguments and Background
Simon Leech, defending, acknowledged Lacey's behavior was "wholly inappropriate" but argued it occurred in the context of an argument where Lacey expressed doubts about his paternity. Leech emphasized that no physical violence occurred during the incident.
The defense lawyer attributed Lacey's actions to a "chaotic family background" and troubled upbringing, but noted significant progress since the incident. "He has matured greatly since this incident," Leech told the court. "For a man with his background, using his words instead of lashing out is significant."
Lacey, of Smithfield Road in Norton, admitted to common assault. The court heard he has previous convictions for burglary and assault but has not committed any offences since this incident.
Sentencing and Conditions
Magistrates decided against imprisonment, instead handing Lacey an 18-month community order with specific requirements:
- A 26-day rehabilitation activity requirement
- A GPS ankle tag for six months to monitor his movements
- Payment of £469 in court costs
The sentence aims to address Lacey's behavior while allowing him to continue working on bettering himself, as noted by his defense counsel during proceedings.
