Drunk Driver Sentenced to Over a Decade for Fatal 80mph Collision

A drink driver has been jailed for ten-and-a-half years after killing his friend in a horrific high-speed crash on the A46 in Evesham. Mariusz Kosinski, 37, was found to be more than twice the legal alcohol limit when he lost control of his black BMW 330d, overturning the vehicle and resulting in the death of passenger Pawel Czubacki, 40.

Reckless Driving Captured on Dashcam Footage

Shocking footage from Kosinski's mirror dashcam revealed the moments leading up to the fatal collision on July 27, 2024. The video shows him driving on the wrong side of the carriageway, speeding past 14 cars and two motorbikes, with the speedometer reaching 80mph. Witnesses reported hearing loud screeching tyres and seeing his wheels spin on the Twyford Island roundabout before he accelerated onto the A46 Evesham Bypass.

Judge Nicholas Cartwright, sentencing at Worcester Crown Court, stated that Kosinski deliberately ignored road rules and demonstrated a disregard for other road users while "showing off". The court heard how he overtook numerous vehicles, putting everyone at risk, and proceeded along the middle of the carriageway towards Badsey Island before losing control.

Alcohol Levels and Aftermath of the Crash

A roadside breath test conducted after the crash at 5.30pm recorded Kosinski with 80mcg of alcohol per 100ml of breath, significantly above the legal limit of 35mcg. Further blood tests later confirmed he was over the limit, registering 84 milligrams per 100 millilitres. Emergency services attended the scene, but despite their efforts, Mr Czubacki died at the site of the collision.

Dashcam audio captured Kosinski screaming in Polish after the crash, "F***! He is dead mate! I killed the dude. F***! Buddy! I killed him!". He was arrested by officers who detected alcohol on his breath and subsequently convicted of causing death by dangerous driving.

Police and Legal Response

Detective Constable Danny Somner of West Mercia Police commented on the case, saying, "We are pleased to get this conviction and sentencing for Kosinski today whose appalling driving resulted in the tragic death of his passenger and put many other motorists at risk of serious harm that day." He added that the footage showed Kosinski's usual driving was risky and dangerous, justifying the lengthy prison term and driving ban.

In addition to the prison sentence, Kosinski has been disqualified from driving for 13 years. The case highlights the severe consequences of drink driving and reckless behavior on the roads, serving as a stark warning to other motorists about the dangers of speeding and alcohol impairment.
