Dudley Nursery Pleads Guilty in Corporate Manslaughter Case Following Toddler's Death

A Dudley nursery has admitted causing the death of a 14-month-old boy in a major court development. Fairytales Day Nursery, located on Bourne Street, changed its plea to guilty for corporate manslaughter at Wolverhampton Crown Court on Wednesday, March 25.

Tragic Incident and Legal Proceedings

The case centers on the tragic death of Noah Sibanda, who passed away after an incident at the nursery on December 9, 2022. Initially, the nursery had entered a not guilty plea to the corporate manslaughter charge, but this was altered during the recent court hearing.

The guilty plea acknowledges multiple critical failures:

  • Failure to ensure children in the baby room were put down to sleep safely
  • Failure to ensure staff received adequate training for putting babies to sleep
  • Failure to provide proper supervision of staff during these procedures

Additionally, the nursery pleaded guilty to failing to discharge the general duty of care under section three of the Health and Safety at Work Act 1974, covering the period from November 29 to December 9, 2022.

Individual Defendants and Sentencing

Business owner Deborah Latewood, 55, of Himley Avenue in Dudley, also changed her plea to guilty for the same health and safety charge. She had previously denied involvement in Noah's death and was scheduled for trial later this year.

Nursery worker Kimberley Cookson, 23, of The Broadway in Dudley, had already admitted to one count of gross negligence manslaughter in connection with the tragedy last year.

All defendants are expected to be sentenced on April 16, though this date may be subject to change. Judge Michael Chambers KC renewed their bail and emphasized the importance of maintaining contact with their solicitors.

Aftermath and Closure

Ofsted permanently closed Fairytales Day Nursery in April 2023, following the investigation into Noah's death. The case has highlighted significant concerns about safety protocols and staff training in childcare facilities.

The court's decision marks a pivotal moment in this heartbreaking case, bringing some measure of accountability for the failures that led to the loss of young Noah Sibanda's life.
