Birmingham Man Abused Neighbor and Police Officer

Adam Duffy, 37, of Elkstone Court, Birmingham, has been sentenced at Birmingham Magistrates Court for racially abusing his neighbor and homophobically insulting a police officer. The court heard that on November 15, 2024, Duffy hurled racist slurs from his upstairs window, calling his neighbor a 'f****** m*****' and a 'f****** tramp,' after a report was filed to the council about his behavior.

Details of the Abuse

Prosecutor Ms Begum told the court that the victim went outside and heard Duffy shouting from his kitchen window. The defendant also claimed the victim had 'rats in her garden.' When the victim asked what was going on, Duffy responded, 'just because you are black, you cannot bully me.' Later that day, Duffy returned to the victim's property, and the victim stated Duffy could 'do what he wanted because he was white.'

The court was informed that Duffy was under the influence of drugs and alcohol during the incident. He also directed homophobic slurs at a police officer, calling him a 'batty boy' and 'gay,' and caused damage to a police cell.

Defense and Sentencing

Mr Ball, defending, did not extensively discuss his client's character but argued that compensation to the neighbors was not 'helpful' due to a subsequent reconciliation. He stated, 'He [Duffy] has reconciled with the neighbours. He is a man who has worked in the past, but because of mental health issues, he has had to receive state benefits.'

Sentencing, Mrs Roberts JP, Mr Welsby JP, and Mr Wheatley JP called Duffy's conduct 'unacceptable.' For racially or religiously aggravated harassment without violence, Duffy received a 12-month community order with 25 rehabilitation days, three months of alcohol treatment, and a £100 fine. For criminal damage to the police cell (valued under £5,000), he was ordered to pay £100 compensation. For the third offence of racially or religiously aggravated harassment, alarm, or distress by words or writing, no separate penalty was given. Additionally, he must pay £85 in costs and a £190 surcharge.
