DWP Enforces New Regulations for Disability and Carer Benefit Recipients Relocating to Scotland

The Department for Work and Pensions has rolled out significant new rules impacting individuals receiving Personal Independence Payment, Disability Living Allowance, Attendance Allowance, or Carer's Allowance who move permanently to Scotland. These changes, which took effect from February, stem from the devolution of social security powers to Scotland under the Scotland Act 2016.

Key Changes for Benefit Claimants

Under the updated framework, claimants who relocate from England or Wales to Scotland must now engage with Social Security Scotland to transition to equivalent Scottish benefits. This shift is part of Scotland's broader initiative to establish a social security system grounded in principles of dignity, fairness, and respect, as outlined on the Scottish government's official website.

Specific Benefit Transitions

Personal Independence Payment (PIP): All anticipated PIP cases have been transferred to Adult Disability Payment. Starting November 6, 2025, any PIP recipient in Scotland will need to submit a new application for Adult Disability Payment to continue receiving support.

Carer's Allowance: Social Security Scotland has completed the transfer of all expected cases from Carer's Allowance to Carer Support Payment. Claimants who have not received a notification letter about this transition are advised to contact Social Security Scotland directly.

Attendance Allowance: This benefit is being replaced in Scotland by Pension Age Disability Payment as part of the devolution process. From the end of February, Attendance Allowance awards began automatically migrating to the new Scottish benefit.

Disability Living Allowance (DLA): Social Security Scotland has identified all DLA cases slated for transfer to Scottish Adult Disability Living Allowance. Individuals living in Scotland who still receive DLA and have not been informed of the move should reach out to Social Security Scotland for clarification.

Implications for Claimants

The rule change mandates that Attendance Allowance customers moving permanently to Scotland must file a new claim for Pension Age Disability Payment. Similarly, DLA customers need to contact Social Security Scotland to discuss eligibility for Scottish Adult Disability Living Allowance. This overhaul extends to all disability benefits, including PIP and Carer's Allowance, reflecting Scotland's expanded authority over social security matters.

Claimants are encouraged to stay informed and proactive in managing their benefit transitions to ensure uninterrupted support during this period of administrative change.
