Birmingham Drink-Driver Three Times Over Limit Warned

A drink-driver who was three times over the legal limit has been warned that bailiffs will come knocking if he fails to pay his fine. Tanyaradwze Magwenzi, aged 23, of Fairburn Close, Nottingham, was found at the scene of a collision between a Ford Eco Sport and a bollard on May 3 this year.

Magwenzi pleaded guilty to drink driving at Birmingham Magistrates' Court on Tuesday, June 2. He was fined £1,118 after tests showed he had 106 micrograms of alcohol in 100 millilitres of breath, more than three times the legal limit of 35 micrograms.

Court Hearing Details

Appearing unrepresented, Magwenzi told the court he was living with his brother and had no current income. Prosecuting, Ms Begum explained that officers were called to Constitution Hill after a vehicle collided with a bollard. The defendant initially denied being the driver but later admitted he had driven to the location.

He said he had travelled from Derby to a Travelodge where he was staying, then drove to the location of the collision. He claimed his last drink was at 6pm. Officers described him as appearing dazed and smelling of alcohol.

Previous Good Character

Magwenzi was a man of good character with no previous convictions. The magistrates opted for a financial penalty rather than a community order. He received a 24-month driving ban and must pay £1,118, comprising a £738 fine, a £295 victim surcharge, and £85 prosecution costs.

The chair of the magistrates warned him: "If you fail to pay the fine, the bailiffs will come knocking on your door."
