Midlands Motorist Receives 40-Month Driving Ban for Second Drink-Driving Offence
A drink driver from the Midlands has been banned from the roads for more than three years after being caught nearly double the legal alcohol limit. Jabal Abdollah, 38, of Hobgate Road, Wolverhampton, pleaded guilty to driving while above the alcohol limit at Birmingham Magistrates' Court.
Court Hearing Details and Evidence
On March 28 this year, police officers followed Abdollah's Ford S-Max in West Bromwich due to suspicious driving behaviour before pulling him over. He initially claimed to have had 'one or two drinks' and blew 77mcg in a breath test at the scene. After being taken into custody, an evidential test recorded 62mcg in 100ml of breath, significantly above the legal limit of 35mcg.
During the hearing on April 14, the court heard that Abdollah had a previous conviction for drink-driving from December 2017, for which he was disqualified for nine months in 2019. This prior offence aggravated the current case, leading to a harsher penalty.
Sentencing and Court Remarks
Abdollah was disqualified from driving for 40 months, equivalent to three years and four months. When the ban was announced, he questioned whether he had misheard '14' instead of 40 months. The chair of the Magistrates clarified, stating, '4-0, 40 months, you can't drive on any road for the next 40 months.'
The chair explained the severity of the sentence, noting, 'That is because it's your second offence, it is very serious.' Typically, drink drivers might be offered a course to reduce their ban, but this option was not extended to Abdollah due to the high alcohol level and the presence of a passenger in the car.
In addition to the driving ban, Abdollah was fined a total of £375. The court warned him that failure to pay could result in bailiffs being sent to his home, advising prompt payment to avoid further consequences.

Ms Pogorzelska, prosecuting, detailed the incident, highlighting that police observed suspicious driving and noted the passenger in the vehicle. This factor, combined with the elevated alcohol reading and previous conviction, underscored the risks posed by Abdollah's actions.
