Birmingham Man Assaults Court Security Guard After Final Drink Before Prison
David Bird, a 57-year-old resident of Tinkers Farm Road in Birmingham, has been fined after assaulting a crown court security guard while intoxicated during his own sentencing hearing. The incident occurred at Birmingham Crown Court on March 27, following a burglary trial where Bird was due to be sentenced.
Drunken Arrival Leads to Confrontation
Bird had been waiting since 9.30am for his hearing, which was delayed until 3pm. Assuming he would be going to prison for a significant period, he decided to have what he described as his last drink while awaiting the proceedings. Upon returning to the court, security personnel immediately noticed his drunken state and instructed him to leave the premises on two separate occasions.
Prosecutor Ms Pogorzelska detailed the events, stating, He was asked to leave, and he did, but he tried to enter again and when asked to leave, he has gone towards the security guard and pushed him in the chest, not causing any injury. The assault involved Bird pushing the officer in the chest, though no physical injuries were reported.
Legal Proceedings and Sentencing
In his defense, Mr Mirza explained that Bird's actions were influenced by the anticipation of a lengthy custodial sentence, leading him to consume alcohol as a final act before imprisonment. However, the chair of magistrates emphasized that the offence was aggravated by Bird being on bail at the time and assaulting a public servant who was merely performing his duties.
Bird pleaded guilty to common assault at Birmingham Magistrates' Court this week. He was fined a total of £275, which includes a £54 victim surcharge and £85 in court costs.
