Evesham Driver Receives Lengthy Prison Term for Fatal Collision Following Reckless Overtaking

An aggressive and erratic driver from Evesham has been imprisoned for more than a decade after a series of dangerous overtakes led to a horrific crash that claimed the life of his passenger. Mariusz Kosinski, aged 37, was sentenced to ten and a half years in jail for causing death by dangerous driving on the A46 Evesham bypass.

Details of the Fatal Incident

The tragic event unfolded on Friday, July 27, 2024, around 5:30 PM, when Kosinski, who was over the legal alcohol limit, drove his black BMW 330d on the wrong side of the road to overtake multiple vehicles and motorbikes in Worcestershire. Witnesses reported hearing loud tyre screeches and seeing wheels spinning at the Twyford Island roundabout before he exited onto the A46 Evesham Bypass heading southbound.

As Kosinski continued his dangerous maneuvers, he approached Badsey Island, driving down the centre of the road in an attempt to overtake another car. With the central gap narrowing and an oncoming vehicle present, he lost control while trying to manoeuvre around it. His BMW went into a spin, slid sideways towards the island, flipped over, and landed on its roof, coming to rest in a grass verge and hedgerow.

Legal Proceedings and Evidence

Despite the efforts of emergency services, the front-seat passenger, Pawel Czubacki, 40, suffered fatal injuries and was declared deceased at the scene. Kosinski was arrested, with officers noting the smell of alcohol on his breath. He failed a roadside breath test, recording 80 micrograms of alcohol per 100 millilitres of breath—more than twice the legal limit of 35 micrograms. Later blood tests confirmed he was over the limit, registering 84 milligrams per 100 millilitres.

During the trial at Worcester Crown Court, damning evidence from a dashcam unit recovered at the scene showed Kosinski's dangerous driving immediately before the crash and earlier in the day. He was convicted on Friday, February 13, 2026.

Sentencing and Judicial Remarks

Sentencing Kosinski, His Honour Judge Cartwright criticised his driving for both excessive speed and the reckless overtaking of 14 vehicles and two motorbikes ahead of the fatal collision, despite fast oncoming traffic. HHJ Cartwright noted that Kosinski deliberately ignored road rules, showing a disregard for other road users' safety while "showing off" his car's high-speed performance.

In addition to the prison term, Kosinski was banned from driving for 13 years. Detective Constable Danny Somner of the Serious Collision Investigation Unit South commented after the case, stating that Kosinski's appalling driving resulted in a tragic death and put many others at risk, exacerbated by his alcohol consumption.

He emphasised that while no sentencing can compensate for the loss of life, it provides an opportunity for Pawel's family and friends to begin moving forward. The dashcam footage revealed that Kosinski's driving was consistently risky and dangerous, justifying the lengthy ban and imprisonment.
