The Department for Work and Pensions (DWP) has issued a stern warning that eight groups of parents could face legal action if they fail to report specific changes in their children's circumstances while receiving Disability Living Allowance (DLA). The DWP enforces strict rules for claimants, emphasizing that providing incorrect information or neglecting to report changes could result in court proceedings or financial penalties.
Key Changes That Must Be Reported
Claimants are required to notify the DWP of any alterations that could affect the amount of DLA their child receives. The benefit offers three rates: a lower rate of £30.30 per week, a middle rate of £76.70, and a maximum rate of £114.60 per week (equivalent to £458 per month). The eight specific changes that must be reported include:
- Your child’s personal details change, such as their name, address, or doctor
- The level of help they need or their condition changes
- A medical professional has indicated they are nearing the end of life due to a life-limiting illness
- They go into hospital or a care home
- They plan to travel abroad for more than four weeks
- They are imprisoned or held in detention
- Their immigration status changes if they are not a British citizen
- They enter a residential school
Payment Details and Special Rules
DLA is typically paid every four weeks on a Tuesday. If the payment date falls on a bank holiday, claimants usually receive their payment before the holiday, with subsequent payments continuing as normal. For children nearing the end of life, the DWP offers expedited processing under the "special rules for end of life," which may allow for a higher rate and faster claim approval. The DWP acknowledges that predicting life expectancy can be difficult and encourages parents to seek support from a medical professional if needed.
