Birmingham Taxi Driver Loses Appeal After Licence Revoked Over Multiple Complaints
A Birmingham-based taxi driver has lost his appeal against the revocation of his licences after a court upheld council findings that he was not a "fit and proper person" to hold them.
Mohammed Chowdhury, 56, of Starbank Road in Small Heath, held both a Hackney Carriage licence and a Private Hire Driver's licence with Tamworth Borough Council.
Series of Concerns Led to Licence Revocation
The council's licensing committee heard the case in August 2023 and again in March 2024 after multiple concerns were raised about Chowdhury's conduct as a licensed driver.
The issues identified included:
- Accumulation of penalty points on his driving record
- Multiple complaints from members of the public
- Submission of an inaccurate accident report
- A petition from the Hackney Carriage Trade Association questioning his suitability
Based on these concerns, Tamworth Borough Council revoked both of Chowdhury's taxi licences, determining he did not meet the required standards for licensed drivers.
Court Upholds Council Decision
Chowdhury appealed the revocation decision to Telford Magistrates' Court, but on Tuesday, March 24, the court dismissed his appeal.
The magistrates agreed with the council that "the action taken was appropriate and necessary to protect public safety and maintain standards within the licensed trade."
In addition to upholding the licence revocation, the court awarded Tamworth Borough Council £3,000 in costs.
Council Emphasizes Public Safety Commitment
Stephen Gabriel, chief executive of Tamworth Borough Council, welcomed the court's decision, stating: "Public safety is at the heart of everything we do, and it's essential that all licensed drivers meet the high standards expected of them."
Gabriel emphasized that the case followed "a thorough and evidence-led process" where concerns were carefully considered before any decision was made.
"The court's ruling reinforces that our approach is both fair and robust," he added. "We will always support drivers who meet our standards and engage positively with us. However, where there are serious concerns about an individual's conduct or suitability, we will take decisive action and will not hesitate to defend those decisions in court."
The case highlights the rigorous standards applied to licensed taxi drivers in the region and the consequences for those who fail to meet them.
