Birmingham Man Drunk in Court Assaults Guard After 'Final Drink'
A Birmingham man assaulted a crown court security guard after arriving drunk for his own sentencing hearing, a court was told this week. David Bird, 57, had gone for what he described as a 'last drink' while waiting for his case, assuming he would be going to prison 'for some time' that day.
Incident at Birmingham Crown Court
The incident occurred on March 27 at Birmingham Crown Court. According to prosecutor Ms Pogorzelska, security staff noticed Bird was intoxicated when he entered the building for a delayed hearing. He was asked to leave twice, but upon attempting to re-enter, he pushed a security guard in the chest, though no injury was caused.
Bird, of Tinkers Farm Road, Birmingham, pleaded guilty to common assault and was fined for the crime. The court heard he had a previous battery conviction from 2015 and was on bail for an ABH charge at the time, making this offence committed while on bail.
Defendant's Explanation and Apology
Defending, Mr Mirza explained that Bird had been waiting since 9:30 AM for his sentencing on a burglary charge, which was pushed back to the afternoon. Bird said he believed he was going into custody for an extended period and therefore had his 'last drink.'
Mr Mirza added that Bird apologized to the officer immediately after the incident, and the guard was reportedly satisfied with the apology. The harm caused was described as very low level, primarily causing discomfort.
Court's Response and Penalty
The chair of the Magistrates emphasized that the offence was aggravated by Bird being on bail and assaulting a public servant performing their duty. Bird was ordered to pay a total of £275, which includes a £54 victim surcharge and £85 in court costs.
A collection order was also put in place, meaning bailiffs could be sent to his home if payments are not made. This case highlights the serious consequences of such actions in a court setting, particularly when involving those already on bail.
