The Department for Work and Pensions has confirmed significant changes to the rules governing Personal Independence Payment and Attendance Allowance for certain claimants. These new regulations specifically impact residents of England or Wales who receive disability benefits and decide to relocate permanently to Scotland.

Changes to Cross-Border Benefit Transfers

Previously, individuals receiving Attendance Allowance and Disability Living Allowance who made permanent moves from England or Wales to Scotland had their cases automatically transferred to Social Security Scotland. This automatic transfer system concluded on February 23, 2026, marking a substantial shift in how these benefits are administered across borders.

The DWP has clarified that under the new rules, Attendance Allowance customers who move permanently to Scotland must now submit a new claim for Pension Age Disability Payment through the Scottish system. Similarly, Disability Living Allowance recipients need to contact Social Security Scotland directly to discuss their eligibility for Scottish Adult Disability Living Allowance.

Potential Payment Gaps and Official Guidance

Officials have acknowledged that these procedural changes might create temporary gaps in payments for some claimants during the transition period. Karyn Dunning, deputy director at Social Security Scotland, emphasized the importance of timely action for disabled individuals and carers relocating to Scotland.

"It's vital disabled people and carers who move to Scotland take action to ensure they continue to get the financial support they are entitled to," Dunning stated. "We know applying for benefits can feel daunting, especially alongside moving to a new country, but there is an in-depth guide available on official Scottish government websites."

Support Systems and Philosophical Differences

Social Security Scotland has established multiple support channels to assist with the transition, including telephone assistance, webchat services, and face-to-face appointments with community-based advisors. The agency emphasizes its distinct approach to benefit administration compared to the DWP system.

"The Scottish approach to benefits is very different from that of the DWP," Dunning explained. "For example, we do not use private sector assessors to make decisions. Our system is built on the principles of dignity, fairness and respect, and we want disabled people and carers to get every penny they're entitled to."

These regulatory changes represent a significant development in how disability benefits are managed across UK borders, requiring claimants to be proactive about their benefit status when changing residency between England, Wales, and Scotland.
